           Due to lapses in tax allocating system of initial period, the government had to plea in court against many Malgujars (Tax collectors) for tax collection. The workers ., officers at lower positions in Tax department as Tehsildar, Kanungo, Patwari  and even Malgujar and Sayana started exploiting farmers by transferring farmer’s right on their own names. The famers were unaware about terminology of taxation.  The tax employees used to collect money from farmers but did not write on register. British administration started auctioning land of such farmers as if they were defaulters. The corrupt officials used to show the auctioned land to the properties of their relatives. High level officers were unaware about the lower position officer using corrupt practices (Dharmabhanu).
   Trail understood the lapses and he put a condition that Malgujar would not leave before the agreement rime set. Till, 1826, Trail did not ask for the differences between tax allocation and actual receipt. Trail, in 1828, wrote to Board of Commissioners that Company did not provide the agriculture development money for Kumaon and Garhwal (Atkinson page 238). Trial informed that there was no balance tax for collection. Atkinson etc praised Trail. However, the reality was different. Trail used to auction the land of farmers who could not pay tax. The auction money used to be  six or eight times more than actual tax. Trail was very strict in collecting tax or in auctioning defaulter’s land (Dabral).
